1. Acceptance of the Terms

By accessing or using the TourAI website and mobile application, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services or our website.
Use of the mobile application also implies acceptance of the full terms embedded in the app at the time of registration (including age eligibility, payments and permissions). In the event of any difference regarding the mobile service, the app terms prevail.
1.1. Minimum age
To create an account in the app or on the website you must declare that you are at least 16 years old, or the minimum age required in your country with the consent of the person exercising parental authority, where applicable. TourAI does not technically verify age. Detail and the notice regarding minors appear in the application terms.
2. Description of the Service
TourAI provides a tourist assistance service through immersive, geolocated audio guides, and an associated web portal. The service includes:
- AI chat, voice queries, geolocated audio narrations and an interactive map with guided walking routes (require an internet connection and an active plan in the app; not turn-by-turn navigation).
- Geolocation for real-time points-of-interest suggestions (with an active plan in the app).
- A record of places already presented by the tourist guide so they are not repeated, which you can clear from the app (see the Privacy Policy for detail).
- Redemption of bonuses or promotional codes (manual entry or QR scanning with the device camera in the mobile app) to activate a free plan in enabled campaigns.
- Purchase of paid plans from the account dashboard on tourai.es via Stripe, with payment history and plan activation after payment is fulfilled.
- Account on tourai.es for access to the private area (profile and dashboard), when enabled.
- Community: public forum of topics and replies (news, help, ideas and travel).
- Reviews: voluntary star ratings and an optional comment about the website or the app, published after moderation.
3. Responsible Use and Safety
The user acknowledges that audio guides are used while moving through public environments. TourAI is not responsible for:
- Accidents, falls or road incidents arising from distraction due to use of the application.
- Changes in the accessibility of monuments or streets described in the guides.
- Penalties for using devices in areas where it is prohibited.
We strongly recommend using headphones and always keeping visual attention on the physical surroundings before continuing to walk.
3.1. Community, reviews and user-generated content
The Community and Reviews are hosting spaces for content generated by registered users. By posting, you represent and warrant that you are sufficiently entitled to publish the content and that it does not breach the law or third-party rights.
Conduct rules. The following are prohibited, on a non-exhaustive basis: unlawful, defamatory, insulting or discriminatory content, or content that incites hatred or violence; spam; unauthorised advertising; third-party personal data without a sufficient legal basis; malware or attempts to circumvent security measures; the use of expressions or terms that are not permitted and are detected by control systems; and, in general, any use of the Community or Reviews unrelated to the purpose of the TourAI service.
Reviews. Rating is voluntary: you are not obliged to submit a review to use the service. If you choose to rate, submission requires stars (1 to 5) and the comment is optional. Each account may maintain, at most, one review per target (web or app). Reviews are not shown publicly until approved by moderation. TourAI does not guarantee publication or a specific review timeframe.
Community — prior moderation regime. Community messages (topics and replies) are, as a general rule, subject to a prior review regime. Until publication, content may remain pending and not be visible to the public. TourAI, itself or through authorised personnel, may approve or reject each message. TourAI may also use automated technical means — including filtering of non-permitted terms — to assist moderation, without this implying a general obligation to monitor all content in advance. Such filters may block submission of a message before it is stored, so that attempt does not remain pending moderation. In certain cases, based on objective history criteria (for example, a sufficient number of previously approved contributions and the absence of rejections), TourAI may automatically approve a message; such automatic approval does not limit the right to withdraw, hide or reject the content later.
Community — restriction of the ability to post. Each rejected message is counted for moderation purposes. An accumulated number of rejected messages — currently three (3) — may result in a restriction of the ability to post in the Community: you may continue to access content in read-only mode, but you may not create new topics or replies while the restriction remains in force. TourAI may also impose that restriction immediately in the event of serious or repeated breaches of these Terms or the conduct rules, without needing to reach the stated threshold. The restriction is independent of a full account suspension or block (section 5.1). By accepting these Terms you expressly accept this regime and acknowledge that it prevails over any expectation of unrestricted posting. No claim shall lie against the reasonable exercise of moderation, without prejudice to your non-waivable consumer rights and the right to lodge a complaint with TourAI at info@tourai.es.
Moderation and actual knowledge. TourAI may hide, reject, edit moderation metadata or remove content, of its own motion or following a notice, when it considers that it breaches these Terms, the law or puts users or the service at risk. Hiding may be carried out without immediate physical deletion (soft-hide). There is no general obligation to monitor all content in advance, without prejudice to prior moderation of Reviews and of the Community, and to action following actual knowledge, in accordance with applicable rules on intermediary content services (including, where applicable, Regulation (EU) 2022/2065).
Notice of unlawful content. If you detect content that you consider unlawful or that breaches these Terms, write to info@tourai.es indicating the URL or a sufficient description and, if possible, the reasons. We will handle good-faith notices with reasonable diligence.
Licence over your content. You retain ownership of your content. By publishing it, you grant TourAI a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, reproduce, display, distribute and technically adapt that content (including anonymised Community content after account closure, while it remains on the service) in connection with the service, moderation and legitimate promotion of TourAI. Reviews are deleted with the account. This licence ends when the content is no longer available on the service, without prejudice to backups or legal obligations.
Author's responsibility. You are solely responsible for the content you publish. User reviews do not necessarily represent TourAI's position.
4. Intellectual Property
All content owned by TourAI — including AI-generated guide texts, audio, logos, designs, source code and the shared points-of-interest catalogue — is the exclusive property of TourAI or is held under the corresponding licences. Reproduction or distribution without express authorisation is prohibited. User-generated content is governed by section 3.1.
5. Plans and promotional bonuses
Access to the map, artificial intelligence chat, audio guides and tour features in the mobile application requires an active plan (full contractual details appear in the terms embedded in the app):
- Active plan: map, chat, audio guides and guided tour with usage allowance while the plan is valid.
- Promotional ads (app): TourAI messages (text and audio) shown only to accounts without an active plan, aimed at purchasing or activating a plan.
- Paid plans: temporary plans (for example, 1 day or weekend) that activate usage allowance.
- Promotional bonuses: TourAI may grant a free active plan through alphanumeric codes or QR codes distributed in campaigns (WELCOME campaign on first registration, BIRTHDATE campaign for birthdays, bonuses pre-assigned to the user's email or other campaign codes). In particular:
- Bonuses are associated with the user's account; they are not transferable, resaleable or redeemable for money.
- If there is a bonus pre-assigned to the user's email (a campaign other than WELCOME, for example BIRTHDATE or another active promotion), it takes priority over the welcome bonus. If the user redeems another promotional bonus after first access, the WELCOME bonus is paused.
- For birthday bonuses (BIRTHDATE), the user may optionally indicate their date of birth in the profile. If they do not provide it, they will not be able to receive that type of bonus automatically.
- Bonuses have a maximum activation or consumption period of 30 days from redemption or automatic assignment.
- Purchased plans have an activation period of 60 days (2 months) from acquisition, unless otherwise indicated on the purchase screen.
- The same code may allow several total redemptions (different users), but each user may redeem the same code only once.
- Redemption is carried out in the app (Profile → Redeem bonus / code), by entering the code manually or scanning the QR with the camera of the device when the platform allows it (Android/iOS). Scanning uses the live camera; QR images and video recordings are not stored.
- Valid QR codes contain a promotional code or a link on the TourAI domain (for example,
tourai.es/promo?code=...). - In the plan history, those obtained via bonus or promotional code are distinguished from those acquired by purchase.
- TourAI may limit, suspend or withdraw codes for fraud, abuse, breach of the terms or end of the campaign.
Fraudulent or automated redemption of codes, forgery of codes or QR codes, or attempts to exceed per-user or per-code usage limits are prohibited.
Allowance exhausted in the app: when the active plan's usage allowance runs out in the mobile app, TourAI may notify you by audio and start purchase of a new plan. If the exhausted plan was purchased, the app may offer repurchase of the same plan through the relevant store or gateway, with no charge until your explicit confirmation. If it came from a promotional bonus, the app will guide you to plan selection. Once payment is confirmed in the store or gateway in this flow, the purchased plan may be activated automatically as your active plan. Full contractual detail appears in the terms embedded in the app (section 7).
5.3. Plan payments on the website (tourai.es)
Registered users may purchase plans from the tourai.es account dashboard. Payment is processed through Stripe (a third-party gateway). TourAI does not store full card numbers.
Before redirecting you to Stripe, TourAI creates a plan and payment record in a pending state. If you complete payment, the record becomes paid and the plan will appear under "Your plans" for activation according to the product rules. If you cancel checkout in Stripe, no charge will be made and the record may show as cancelled. If you leave the process unfinished, it may remain pending until the payment session expires.
TourAI may verify the session status with Stripe (for example when you sign in or open the dashboard) to update records. Payment history reflects all registered attempts; acquired plans list only those that are paid or free via bonus. Full contractual details on withdrawal, refunds and app stores appear in the terms embedded in the app (section 8), which supplement this section.
5.1. Account suspension
TourAI may suspend or block accounts for fraud, abuse, breach of the Terms (including misuse of the Community or Reviews), or risk to service security. If your account is blocked, you will not be able to sign in until the suspension is lifted. We may also hide or remove your public content. The restriction of the ability to post in the Community described in section 3.1 may apply without suspending access to the rest of the service. You may contact info@tourai.es to lodge a complaint.
5.2. Single session per device
Each account maintains a single active session, associated with the device from which you signed in. If you try to access from another device, you may choose to close the open session in order to continue; the previous device will disconnect as soon as it detects the change. Signing out in an orderly way frees the session immediately; if the app is force-closed or the device is switched off, the session is released automatically after a short period of inactivity. Do not share your credentials: if another person wants to use TourAI, we recommend creating a separate account. See the full detail in the mobile application terms.
6. Device permissions (mobile app)
The application may request location, microphone, camera, gallery or photo library (profile photo) and optional biometrics permissions. Refusal may limit features. See the full app terms for detail.
7. Limitation of Liability
TourAI strives to offer accurate historical information; however, we do not guarantee that the content is free from errors or omissions. The platform is provided "as is" and its use is at the user's own risk.
8. Account deletion
If you do not want TourAI to use your email or other account data, you must delete the account. You may do so from the app (Edit account → Delete my account) or from Delete account on the website. In both cases you must verify your email with a 6-digit code. Only if you cannot access those channels may you write to info@tourai.es. On deleting the account the trail of your profile and usage history is erased (including your reviews and the record of places presented by the guide). Community posts are not removed from the thread, but they are anonymised (label "Anonymous", with no name or email), in accordance with the Privacy Policy.
9. Applicable law, jurisdiction and languages
These terms are governed by Spanish law. Unless a mandatory consumer-protection rule confers another forum, the parties submit to the courts of the consumer's domicile where the user is a consumer and, otherwise, to those of Barcelona (Spain), without prejudice to the provisions of the mobile application terms.
The Spanish version of these legal texts is the reference version (published at tourai.es/terms.html). This English version is published at tourai.es/en/terms.html (other legal pages under /en/). If there is a discrepancy between languages, the Spanish version on tourai.es shall prevail, unless a mandatory rule provides otherwise.
10. Modification of the terms and re-acceptance
TourAI may amend these Terms and/or the Privacy Policy where necessary for legal, technical, security or service-evolution reasons. The version in force will be published on this page (and, where applicable, on the Privacy Policy page) with the "last updated" date.
Relevant changes will be identified by an acceptance version (version code or date) associated with the user's account. On the next access to the application or the website, TourAI will request an express re-acceptance of the updated texts. One acceptance shall be valid for both the application and the website when the same account is used. Until that acceptance is given, the user will not be able to continue the session on the affected services. Mere continued use of the service shall not, by itself, be construed as acceptance of the new conditions. The foregoing is without prejudice to non-waivable consumer rights. Where the change is substantial, TourAI will endeavour, so far as possible, to give reasonable advance notice.
